HG no. 1/2018 Contract Administration
We provide consulting for the technical and contractual administration of execution and design-build contracts subject to HG no. 1/2018, in relation to the form of regulations and contractual conditions applicable to the project. We analyze the contractual agreement, general and specific conditions, technical requirements, the bid, and subsequent documents, tracking the order of precedence and the consistency of assumed obligations. We evaluate risk allocation, design and execution responsibilities, the limits of the Supervisor's authority, and mechanisms for approval, evaluation, and payment of works.
Obligations, deadlines, and notifications
We structure contractual obligations into a matrix that correlates each requirement with the responsible party, triggering event, deadline for completion, and necessary supporting documents. We organize registers for notifications, clarifications, administrative orders, modifications, claims, and decisions, tracking their transmission, receipt, and resolution. We verify compliance with communication channels and content requirements for documents, paying attention to procedural deadlines that may influence the exercise of contractual rights. We correlate these records with the execution schedule and the actual progress of the works.
Delays and execution schedule
We perform delay analyses by examining the baseline schedule, successive updates, and records regarding the actual conduct of activities. We identify disruptive events, affected activities, changes in logical dependencies, and the consumption of float/buffer time. We evaluate the impact on the critical path and the completion date, taking into account concurrent causes, availability of work fronts, and delay mitigation measures. We substantiate extension requests by demonstrating the link between the event, contractual responsibility, and temporal effect, separately analyzing the justification for any associated costs.
Technical and economic modifications
We prepare technical-economic justifications for modifying solutions, quantities, execution sequences, or conditions for performing the work. We describe the necessity of the intervention, affected documents, and consequences regarding functionality, authorization, duration, and contract value. We verify the applicability of existing prices and the substantiation of new prices through analyses of resources, productivity, execution conditions, and relevant market information. We correlate proposals with the contractual evaluation and approval mechanism and with the requirements applicable to the modification of public or sectoral procurement contracts.
Payments and additional costs
We support the preparation and verification of documents supporting payment requests and the quantification of additional costs. We correlate work progress reports with measurements, quality documents, minutes, resource records, and contractual approvals. For claimed costs, we analyze the affected period, the necessity of the expenditure, the connection to the event, and the method of allocation to the contract, based on personnel, equipment, materials, subcontracting, and site organization records. We verify the consistency of calculations and avoid overlap between modification evaluation, price adjustment, and amounts requested through claims.
Claim files and traceability
We develop and analyze claim files by organizing the chronology of events, identifying contractual grounds, and presenting evidence supporting the effects on deadlines and costs. We associate each request with notifications, correspondence, daily records, execution schedules, and relevant calculation documents. For events with a continuous effect, we support the periodic updating of justifications and the consolidation of final documentation. We prepare technical responses to claims and clarifications and support the documentation of the Beneficiary’s or Contractor’s position in contractual consultations and in preparing the analyses required to resolve potential disputes.
